The court examined the reports submitted to it by the WZO management.
In all federations, election committees were established to manage the process. In two of them, special election committees were appointed by the Central Elections Committee.
In most federations, a voter register was prepared as required. In those that were not, a request for exception was submitted for reasons presented to the court.
The court granted this time but made it clear that in the future it would not approve such exceptions.
The court found that the results met the requirements for representation for women and young adults.
Therefore, the court approved the results. This is subject to the outcome of a pending petition by the Ugandan Federation regarding the composition of its delegates and the election results.

Mizrahi Belgium claimed that the World Zionist Organization's election regulations contradict the election regulations in Belgium.
The general regulations prevail and although it did not pass the threshold, it claims because it has a surplus agreement with Eretz HaKodesh, they are counted as one list and Mizrahi is entitled to one delegate. In addition, claims were made of irregularities in the election process.
The court rejected all claims. First, it was determined that the agreement between the lists was not legally concluded and has no validity. Second, it was determined that their interpretation of the election regulations is incorrect. In addition, the court rejected the claim of irregularities due to the lack of substantive evidence.

The Area Election Committee in England
The Area Election Committee in England approved an electoral system that limits the number of seats a list can win to five. This is to ensure diversity in the identity of the elected seats. Eretz Hakodesh argued that this de facto nullifies the surplus agreements signed by the lists.
The parties reached an agreement that the limitation will apply from the sixth seat. That is, a list that wins six seats will lose the sixth seat.
However, to the extent that there is a share of votes that represents parts of a seat (between 5-6), this share will go to the list with which it signed a surplus agreement. This is to the extent that this will complete the number of votes needed for the other list for an additional seat.
The agreement was given binding force in the ruling.

The Eretz HaKodesh movement at the Zionist Congress
-V.-
The Eretz HaKodesh movement claimed in its complaint that Dr. Yizhar Hess, the vice chairman of the World Zionist Organization, and his movement financed a negative campaign denouncing the World Zionist Organization, in order to convince the ultra-Orthodox public to refrain from voting in the elections for the 39th Zionist Congress. Eretz HaKodesh demanded the imposition of sanctions for violating Article 49 of the Constitution and Regulation 41 of the Election Regulations.
Yizhar Hess and the other respondents claimed that in the absence of the WZO attorney, there is no authority to file a complaint and the right to dismiss the complaint. The court accepted the defendants' argument, but offered the defendants alternative mechanisms instead of a complaint, a means that requires a serving WZO attorney.
In addition, as a prospective statement, the court recommended that the WZO consider formulating a binding code of ethics for all activists and bodies within the framework of the Congress and the WZO. The court also emphasized the importance of appointing the WZO attorney within the framework of the 39th Congress.

The Zionist Supreme Court thought that a sufficient factual foundation had not been laid before the Zionist General Council in the case of the Latvian community seeking recognition as a federation. In addition, the Court thought that this was a glorious community of centuries, which has seen itself as part of the Zionist enterprise since the beginning of the twentieth century, went through a difficult period during World War II, is trying to recover and renew itself, and is carrying out Zionist activities. It is doubtful whether this aspect was considered in its full scope by the Zionist General Council.
Therefore, the Court decided that it was appropriate to return the hearing to the Zionist General Council in order to present to it a broad factual picture reflecting the past and present of the Latvian community.

On July 2, 2023, in ruling 0002/2023 the Court determined that Arzenu Italy is entitled to join the Zionist Federation of Italy subject to the fulfillment of certain conditions.
On February 28, 2025, the Respondent announced that it had reached a general decision to accept Arzenu Italy as a member of the Federation. Therefore, and in accordance with the agreement of the parties, the Court determined that our country Italy is a member of the Federation for all intents and purposes. This includes attendance at the election committee meeting that will be held in the near future.
If the ruling is not respected and Arzenu Italy does not receive its rights as an equal member of the Federation, the Court will consider taking measures against the Federation, according to Rule 50 of the Court's Regulations (Case 0012/2024 Herut Movement v. Zionist Federation in France).

Following decisions made at the Zionist General Council 38/4 held in February 2024, a request was submitted to cancel some of the decisions.
These are decisions regarding changes to the WZO Constitution and bylaws.
The court ruled to accept the petition in the part that refers to the registration of individual Zionists through the offices of the World Zionist Organization in Jerusalem.
The court also decided that the other articles of the constitution and bylaws that were the subject of the petition will remain as amended during the ZGC session.
- Against -
The court decided to reject the requests to stop the voting process or to ban the counting of votes.

The court rejects the request of the applicants; because granting the right to present a reservation on each proposed resolution to amend the constitution, given a large number of proposed resolutions, would burden the conduct of the plenary session.

The decision relates to the issues: Which of the 2 respondents was authorized to hold election procedures in Bulgaria; and were there any flaws in the election procedures conducted by each of the two aforementioned respondents separately. The verdict indicates the respondent with the authority, but gives a notice of nullity regarding the election procedure.
The election procedure for the Zionist Congress consists of different stages, a defined schedule, rules and processes as defined in the WZO Constitution and regulations. According to the Constitution, the Zionist Supreme Court checks the accuracy of the procedure in each of the different election areas in the world, and may approve, reject or change the results.
According to the current ruling, three electoral regions were not allowed to send delegates to the Congress: Greece, Guatemala and Sweden. The representatives of other electoral regions were approved.
In this comprehensive ruling, the court expresses its opinion on the election processes in general, points out the weaknesses of some of its stages, the possible deficiencies, and suggests improvements that can optimize one of the important elements of the foundations of the World Zionist Organization: the elections to the Zionist Congress .
